MEDIATION/FAMILY DISPUTE RESOLUTION
About FDR
As a Registered Family Dispute Resolution Practitioner and Nationally Accredited Mediator Debbie is able to undertake mediations in both parenting and property matters. Family Law Property Settlement Mediations can include the legal representatives but usually only if both parties are legally represented. If a matter involves both parenting and property issues then we would usually prefer to mediate the parenting matter first.
One of the many benefits of resolving the issues in dispute via mediation is the financial saving to both of the parties when they are able to avoid costly litigation. Agreements reached through mediation are also more likely to suit the needs of the parties than any Court imposed resolution and therefore more likely to be in the best interests of all involved but especially any children of the parties.
Mediation is voluntary and for the most part confidential subject to any mandatory reporting obligations. This enables parties to negotiate openly without being concerned about the impact on any future litigation.

Parenting Mediations
Each party undertakes an intake assessment of around 1 hour. This is primarily to determine the issues in dispute and whether the matter is suitable for mediation. A small number of disputes may not be suitable and if that is the case a Section 60I Certificate will be issued. If the dispute is suitable then a 3-hour mediation will be allocated, usually within 7-10 days of the intake assessments being completed - subject to the availability of all concerned in the mediation.

Property Settlement Mediations
Stage 1
Each party to the dispute/or their legal representative will be asked to provide an Outline of the Issues in Dispute from his/her perspective as well as a jointly prepared Balance Sheet. A pro forma document in word format can be provided for this purpose. Debbie will then review each parties' position prior to any mediation taking place.
Stage 2
A 3-hour mediation will be allocated, usually within 7-10 days after completion of Stage 1 above - subject to the availability of all concerned in the mediation.
